On October 6, 2022, our team filed a lawsuit on behalf of brothers Dusty and Bucky Stone against the Board of County Commissioners for the County of Quay, the Quay County Road Superintendent, and two private citizens with land adjacent to the Stones’ property. Although the firm focuses its practice on Indian law and representing tribes and their entities, it also represents other clients in similar situations, such as those pursuing claims involving governmental overreach. The complaint seeks declaratory relief, injunctive relief and just compensation and damages caused by the County’s installation of an excessive number of cattleguards. The complaint details nine unnecessary cattleguards abutting and crossing the Stone’s property, most of which are in poor condition and prevent the Stones from moving farm equipment and livestock across their lands and improving and maintaining their property. The litigation comes after repeated requests by the Stones to remove the cattleguards, which the County has consistently refused.
